EviLux Web Studio decides what happens to the information this website collects. In data-protection language that makes us the controller of it.

This policy covers this website. It does not cover a website we build for a client — that site is the client’s, and their own policy applies to it.

What the brief collects

“Start a project” asks seven questions. This is all of them, and there is nothing else on the site that collects anything about you.

Project
The kind of website you need. Required.
Business
What the business does — required. Its name and where it operates can be left blank.
Goals
What the website should help the business do, and a short line of your own if you choose “Something else”. The whole question can be skipped.
Pages
Roughly how much website you think you need — required — and any notes you want to add, which can be left blank.
Timing
When you would like it ready. Required.
Budget
The range you are working with. Required.
Contact
A phone or WhatsApp number, which is required because it is how we get back to you. Your name and email address can both be left blank.

Two facts about the enquiry are recorded with it: which language the page was in, and which page you sent it from. They describe the enquiry, not you.

Nothing else is recorded. There is no IP address, no browser or device information, no referrer, no screen size, no location and no identifier of any kind — not even for spam filtering. Nothing about you is bought from, or shared with, anyone else.

Why we collect it, and on what basis

To read your brief, quote for it, and get back to you about it. That is the whole purpose. EviLux works with businesses and organisations, so a brief normally reaches us from someone acting for a business rather than in a private capacity.

Which lawful basis applies depends on who is writing, and there are two ordinary cases:

You are the client
If you are the business or the person who would be contracting with us, we handle your information because you asked us to — the law calls this taking steps at your request before entering into a contract.
You are writing for someone else
If you are an employee, a colleague or a representative getting in touch on behalf of an organisation, we handle your business contact details and your enquiry on the basis of our legitimate interests: responding to a genuine business enquiry and discussing a possible project with that organisation. You can object to that — see your rights below.

We do not ask you to consent to any of this, and we do not rely on consent: the enquiry does not work without your answers, and there is nothing else we would be asking about.

Your brief is not used to advertise to you, is not added to a mailing list, and is not passed to anyone who might sell to you. Nothing about you is decided automatically, and no profile of you is built.

What happens when you press Send

Your answers are sent to this website’s own server over an encrypted connection, checked, and written to our database. Only once they are safely stored do we send ourselves a notification about them.

The database is the record. The notifications are how we find out a brief arrived, and if one of them fails your brief is not affected — it is already stored, and you are not asked to send it again.

Until you press Send, nothing leaves your browser at all.

Who else handles it

Four providers are involved, and each of them only does what we ask with what we send. Nobody else receives your brief.

Our hosting provider
Runs this website and the server that receives your brief.
Our database provider
Stores the brief. This is the record of your enquiry.
Resend
Sends us one email containing your brief, so we can read it in our inbox. If you gave an email address, it is set as the reply address so we can answer you directly.
Telegram
Delivers the same brief as a message to our own private studio chat, so a mail problem never means a missed enquiry. It is a notification to us, not a way of contacting you.

Some of these providers are companies based outside the European Economic Area, or may store information outside it, including in the United States. Where that happens, it is covered by the data-processing and transfer terms in that provider’s own agreement with us. We are not able to promise that your enquiry is processed only inside the EEA, so this policy does not say that it is.

How long we keep it

If your enquiry does not turn into a project, we keep it for 12 months and then delete it.

If your enquiry does become a project, we keep the records that we actually need for that project — the contract, invoices, payments and the project file — for up to six years, because tax, accounting and dispute records have to be kept for that long. That applies to those records, and not to everything: it is not a reason to hold on to the rest, and it does not mean your original brief is kept for six years by default.

You can ask us to delete your enquiry sooner than any of this, at any time. We will, unless we still need it for a project we are working on for you or have to keep it for a legal, tax or accounting reason — and if so we will tell you which.

What your browser stores

This website sets no cookies. There is no analytics, no tag manager, no advertising or marketing tracking, no social media pixel, and no third-party script measuring anything. There is nothing to consent to, which is why you are not asked to.

It does use your browser’s own session storage for one thing, which the site needs to work as it should: your unfinished brief — your answers and which question you had reached — so a refresh does not throw away what you have typed. Session storage rather than a longer-lived store is deliberate: your phone number should not still be sitting on a shared or public computer after the tab is closed.

It is cleared when you close the tab, and as soon as the brief has been sent. It is not readable by anyone but your own browser, and it is not sent anywhere.

Typefaces are served from this website rather than from a font service, so opening a page does not tell anyone else that you did.

Your rights

Write to us at team@evilux.ie and we will deal with it. We do not charge for any of this, and we will normally answer within a month.

A copy
Ask what we hold about you, and we will send it to you.
A correction
Tell us something is wrong and we will fix it.
Deletion
Ask us to delete your enquiry. We will, unless we still need it for a project we are working on for you or have to keep it for a legal, tax or accounting reason — and if so we will tell you which.
A pause
Ask us to stop using it while something about it is being sorted out — for example while you are disputing that it is correct.
Object
Where we are relying on our legitimate interests — usually when you got in touch on behalf of an organisation — you can object, and we will stop unless there is a good reason not to that outweighs it. Say so and we will act on it.
A portable copy
Where we are handling your information because you asked us to as the client, you can ask for what you sent us in a machine-readable file you can take elsewhere.

We never rely on consent for any of this, so there is no consent for you to withdraw. If you would rather we simply had nothing, asking us to delete your enquiry does that, and you can do it at any time.

If you are not happy with how we handled it

Tell us first — most things are a misunderstanding and are quicker to fix directly.

You also have the right to complain to a data protection authority. In Ireland that is the Data Protection Commission, at dataprotection.ie. If you are elsewhere in the EU or in the UK, your own national authority can take the complaint.

Changes to this policy

If we start doing something this page does not describe — measuring visits, sending a newsletter, taking payment on the website — this page changes first, or at the same time. It is meant to describe the site as it actually is, not as it might be.
